AT
I, MRS. CONSTANCE SUSAN MARY MYERS or DUNLOP, residing at
Crescent Lodge, Largs, widow of Alexander Johnston
Dunlop, Companion of the Most Eminent Order of the Indian Empire, in
order to settle the succession to my means and estate on my death, do hereby
provide as follows:
FIRST.
I
appoint my son Henry Johnston Dunlop and Captain Cedric Sinclair Scott, of Stroove, Skelmorlie,
Ayrshire, to be my Trustees and Executors and I assign and dispone to them for
the purposes aftermentioned All and WHOLE my whole means and estate heritable
and moveable which shall belong to me at the time of my death or over which I
may have power of disposal by Will or otherwise.
SECOND. I bequeath
the articles specified in the list annexed and signed by me as relative here to
to my son Henry Johnston Dunlop whom failing to
any person nominated by him by writing under his hand and failing such
nomination then to his eldest surviving son, my desire and intention being that
the said articles shall be kept as heirlooms in the family of my said son:
And I also bequeath to my said son my
dwellinghouse Crescent Loage, Largs, and pertinents, the whole household
furniture and plenishing the rein and my personal effects, wines, liquors,
consumable stores and motor cars to be disposed of as he may direct.
THIRD.
I
bequeath the following legacies:-
(1) To Edward
Humble, my gardener, Fifty pounds,
and David Carruthers, my chauffeur, Forty pounds, provided they are in my employment
at the date of my death, and are not under notice to leave my service;
(2) TO Mrs.
Humble, the present wife of the said Edward Humble, Twenty five pounds;
(3) To Helen
Marshall, niece of the said David Carruthers,
Twenty five pounds; and
(4) To Margaret
Humble, daughter of the said Edward Humble,
Ten pounds, in token of my regard for her
and her parents.
FOURTH.
I
bequeath to my son Henry Johnston Dunlop or his
Executors one-half of the residue of my means and estate.
FIFTH.
Out
of the remaining half of the residue of my estate I direct my Trustees to pay
(First) to Mrs.
Evelyn Dunlop, widow of my son William Bruce
Dunlop, an alimentary annuity of Three
hundred pounds per annum, but which annuity shall terminate in the event
of her entering into a second marriage;
(Second) to my cousin Miss Lilian Susan Alexina Shand, an alimentary annuity
of One hundred pounds per annum so long as
she remains unmarried;
(Third) an alimentary annuity of Two hundred pounds per annum to Miss Margaret Jean Dunlop, daughter of my grandson Bruce Alexander Johnston Dunlop, but should she marry
without the written consent of my Trustees the said annuity shall ipso facto
cease and determine;
(Fourth) an alimentary annuity of One hundred pounds per annum to Ronald Dunlop, son of the said Henry Johnston Dunlop; and
(Fifth) an alimentary annuity of Fifty pounds to the said Bruce
Alexander Johnston Dunlop:
which
annuities shall be paid by my said Trustees in such sums and at such times as
to them shall seem expedient.
SIXTH,
Should
the said Margaret Jean Dunlop marry with the
written consent of my Trustees the annuity shall continue to be paid to her
until she attains the age of twenty five years or the date of her marriage
(whichever date may be the later) and thereupon it shall cease and I direct my
Trustees to pay her a capital sum of Five thousand pounds as the capital
equivalent to the said annuity.
SEVENTH.
I
direct my Trustees to pay the balance of the one-half share of residue of my
means and estate mentioned in paragraph fifth hereof (subject to implement of the
foregoing bequests) to my said son Henry Johnston
Dunlop or his Executors.
EIGHTH.
I
declare that all bequests under this Settlement or any relative Codicil shall
be free of Government Duty.
NINTH.
I declare that in making the division of my estate it shall be optional
to my Trustees either to convert the whole into cash or to procure a valuation
of such parts as may require valuation and to satisfy the provisions of this
Settlement either in cash or on the basis of such valuation or partly the one
and partly the other all as my Trustees may deem expedient.
TENTH.
Further,
my Trustees are empowered
(a) to retain all investments which I
may have at the time of my death for such time or even during the whole period
of subsistence of the Trust as they may think proper and that whether such
investments may or may not have an uncalled liability or be eligible by law for
Trustees to hold;
(b) to agree to the sale or
amalgamation of any Company and the assets thereof in which they may hold
stocks or shares and to accept in lieu of such stocks and shares other stocks
and shares in any other Company taking over the assets of such Company as
aforesaid or with which the same may be amalgamated;
(c) to subscribe for and accept
additional or bonus stocks and shares in any existing or reconstructed Company
as aforesaid in which my Trustees may be or become: interested as such;
(d) to consent to any alteration or
conversion of stocks or shares; and
(e) to continue to hold for each time
as they may think proper such stocks or shares, or such altered or converted
stocks or shares in lieu of those for which they may have been substituted;
And my
Trustees shall in no case be liable for any loss or damage which may result in
consequence of their exercising any of the powers herein conferred on them.
ELEVENTH. Further, I
authorise my Trustees to appoint a Law Agent, one or more, who may be of their
own number and to allow them suitable remuneration for their services; And I
hereby declare that any Trustees who may be assumed into the Trust hereby
created shall be entitled to exercise all or any of the discretionary powers
hereby conferred on my Trustees as fully and freely as if they had been
appointed hereunder: IN WITNESS WHEREOF these
presents consisting of this and the preceding page 1. are, along with the said
List annexed, subscribed by me at Largs on the twenty fourth day of May Nineteen hundred and
thirty four (24 May 1934) before these witnesses
